Frequently Asked Questions
ARE THERE ANY REQUIREMENTS TO BE ABLE TO CLAIM?
You need to have served in the Armed Forces for at least 2 years at any time since May, 1987.
HOW MUCH IS MY MILITARY HEARING CLAIM WORTH?
Military injury claims can vary greatly in regards to the severity of the injury and how it has impacted on their life. As an example: If your hearing has been compromised, you may be able to apply for a claim that includes financial compensation for pain and suffering, costs associated with medical equipment such as hearing aids, travel costs related to medical appointments, and potential loss of income due to an inability to work.
WILL CLAIMING IMPACT MY CAREER?
No. The MOD understands that they ask service personnel to do a difficult job in dangerous situations – and unfortunately accidents do happen. They recognise and respect the individual’s right to bring a legal claim for injuries. Claiming won’t affect your entitlement to a pension, either. The Ministry of Defence should not discriminate against personnel who bring compensation claims after an injury. If you’re planning on continuing your service career after your claim, then there are very strict rules about discriminating against someone on this basis.
CAN I CLAIM FOR TINNITUS AS WELL AS HEARING LOSS?
Yes. Tinnitus is a ringing, buzzing, hissing or whistling which can be either intermittent or continuous, in one ear or both ears. Depending on how severe the tinnitus is, can cause you to suffer from sleep deprivation and can also cause stress and depression. If your tinnitus has been caused as a result of inadequate ear protection whilst in the military, you may have the right to claim compensation.
WHAT ARE THE SIGNS OF NOISE INDUCED HEARING LOSS?
Signs you should look out for include:
- Mishearing words when you’re in a conversation
- Being unable to hear where there’s background noise
- Having to turn the television up more than others find necessary or needing subtitles
- Missing out on a number of things your partner tells you in passing.
WHY CANT I CLAIM BEFORE 1987?
Before 1987, the Crown Proceedings Act 1947 prevented military personnel from making personal injury claims against the Crown.
